Equal Treatment in Renting: Rights and Limits
A landlord has the right to choose a tenant based on objective criteria such as the ability to pay rent and to properly maintain the property. However, refusing a tenant based on personal characteristics such as gender, age, sexual orientation or other protected criteria constitutes discrimination and is strictly prohibited in Belgium.
To remain compliant, landlords may only request relevant information such as identity, address and proof of income. Sensitive information, such as health status or criminal records, must not be requested.
Types of Rental Agreements in Belgium
There are three main types of residential lease agreements:
- short-term lease (3 years or less)
- standard lease (9 years or more)
- lifetime lease (valid for the tenant’s lifetime)
The duration must be clearly specified in the contract. If no duration is stated, or if it falls between 3 and 9 years, a 9-year lease is automatically applied under Belgian law.
Mandatory Elements in a Rental Contract
A rental agreement must be drawn up in writing and signed by both landlord and tenant. It must include the following information:
- identity of both parties, including national registration number
- start date of the lease
- description of the rented property
- rent amount
- duration of the lease
- charges and additional costs
- reference to the official information brochure on residential lease legislation
Registration of the Lease Agreement
The landlord is legally required to register the lease agreement within two months of signing. This can be done online or through the local Legal Security office where the property is located.
Registration is free of charge. The property condition report must also be registered, either at the same time as the lease or at a later stage.
If the lease is not registered, the tenant has the right to terminate the contract without notice or compensation. The termination takes effect on the first day of the month following the notification.
Rental Guarantee
In most rental agreements, a rental guarantee (security deposit) is requested, although it is not legally mandatory unless explicitly stated in the contract.
This guarantee protects the landlord in case the tenant fails to meet their obligations. The amount and permitted forms depend on the date the lease agreement was signed and the applicable regional regulations in Belgium.
